38 Studios, LLC and its affiliates (collectively, “38 Studios,” “we” or “us”) have designed this Privacy Policy to inform visitors to websites maintained by 38 Studios, including but not limited to www.38studios.com and www.bighugegames.com (collectively, the “Website”), of how we collect, process and use the personal information you submit to us through the Website. We will take reasonable steps to protect user privacy consistent with the guidelines set forth in this policy and with applicable U.S. laws. In this Privacy Policy, “user” or “you” means any person viewing the Website or submitting any personal information to us in connection with using the Website. This Privacy Policy applies only to information collected through the Website, and does not apply to any other information collected by 38 Studios through any other means. By submitting Personal Information, creating a user account or otherwise using the Website, you are indicating that you consent to this Privacy Policy. If you do not agree with this Privacy Policy, you should not submit any Personal Information or use the Website. What Information Do We Collect?
Personal Information: Personal information includes your name, age, address, telephone number, e-mail address, and other information that can be used to identify or contact you (“Personal Information”). To use or access some features of the Website, you need to share certain Personal Information. In some cases, that information is needed and used in order to create a user account (“User Account”), user identification name (“UserID”) and password. We may also collect Personal Information to enable you to participate in features, services, programs and/or other activities from time to time. You can choose whether or not to provide us with this information, but if you choose not to provide any requested information, your experience on the Website may be diminished and some features may not be available or may not work as intended.
If you create a User Account using a third-party social network account, such as Facebook Connect, we will collect information shared by the third-party network according to that third-party’s privacy policy. 38 Studios recommends that when you connect through other web sites, including Facebook, you read the privacy statements of all such third-party sites before submitting any Personal Information to those sites.
You should understand that any information that you post publicly on the Website, for example through any public forum, instant message or chat feature, for any purpose and of whatever nature, medium or format, is considered to be a public disclosure beyond the control of 38 Studios and is not subject to this Privacy Policy.
Aggregate Information: We may collect and record web tracking data that is not correlated to individual users, including domain name, IP address, browser language, browser type, operating system, browsing history (time, date and duration of your visit), referring and exit web pages and URLs, and number of clicks, and may aggregate such information in a manner which does not identify any individual (“Aggregate Information”). Our web servers do not automatically record e-mail addresses of users.
Cookies: From time to time, 38 Studios may send a “cookie” to your computer. A cookie is a small piece of data that is sent to your Internet browser from a web server and stored on your computer’s hard drive. A cookie, by itself, cannot read data from your hard disk or read cookie files created by other Websites. A cookie, by itself, does not damage your system. We may use cookies to identify and keep track of, among other things, those areas of the Website and third-party websites that you have visited in the past in order to enhance your next visit to the Website. Our advertisers may also use cookies to ascertain how many times you have seen an advertisement. We and our advertisers may use this information to better personalize the content, banners and promotions that you see on the Website. You can choose whether or not to accept cookies by changing the settings of your Internet browser. Children: The Website is not intended or designed to attract people under the age of 13. 38 Studios does not knowingly collect Personal Information from any person under the age of thirteen 13 and we do not permit people under the age of 13 to create User Accounts. How Do We Use the Information We Collect?
Personal Information: If you provide Personal Information to us, we may enter such information into our contact management database, and may use such database to send you marketing materials and to contact you regarding your interest in 38 Studios products and services. We may also use your email address without further consent for non-marketing or administrative purposes, for example to contact you regarding issues with your User Account.
Aggregated Data. 38 Studios uses Aggregate Information only in an aggregate form that is not correlated to the individual user, and only for us to examine our traffic in the aggregate, and to understand the performance of the Website. For example, we may develop Aggregate Information on Website and content usage, such as by keeping count of return visitors to the Website and assessing which pages, features and forums on the Website are most popular. This allows us to determine which features visitors like best and to help us improve our content and site, personalize your user experience, and measure overall site effectiveness.
What Information Do We Disclose to Third Parties?
Disclosure of Personal Information. 38 Studios may disclose your Personal Information to certain third-party advertising or marketing partners in order to provide you the added values and special offers of these third parties. You may receive correspondence from third-party companies. You will have the option to participate in these programs when you submit Personal Information or create a User Account. If you no longer wish to participate in these programs, you may remove your Personal Information through the process set forth at the end of this Privacy Policy.
Additional Disclosures. We reserve the right to disclose any information we collect in connection with the Website, without further notice to you (a) to any successor to 38 Studios’ business as a result of any merger, acquisition or similar transaction; (b) to comply with legal process and applicable laws; (c) to enforce this Privacy Policy or the Website’s Terms and Conditions; (d) to respond to claims that any materials, documents, images, graphics, logos, designs, audio, video and any other information provided from or on the Website violate the rights of third parties; or (e) to any law enforcement or regulatory authority to the extent required by law or if, in our reasonable discretion, disclosure is necessary to investigate fraud or any threat to the safety of any individual, or to protect the rights, property or personal safety of 38 Studios, its users or of third parties.
Anonymous, Aggregated Information. We may disclose Aggregate Information to third parties to describe our business and operations, and otherwise to operate and develop 38 Studios’ business.
International Users
38 Studios and its servers are located in the United States and are subject to the applicable state and federal laws of the United States. If you choose to access the Website, you consent to the use and disclosure of information in accordance with this Privacy Policy and subject to such laws.
What Security Measures Are Used to Safeguard Your Information?
We use reasonable physical and technical safeguards to protect the privacy of your UserID, password, User Account and Personal Information. You, however, are ultimately responsible for protecting your UserID, password and User Account information from disclosure to third parties, and you may not circumvent any use of encryption technologies by us. You agree to: (a) immediately notify 38 Studios of any unauthorized use of your UserID, password and/or User Account, or any other breach of security, and (b) ensure that you exit from your User Account at the end of each session. We do not and cannot guarantee or warrant that information transmitted through the Internet is secure, or that such transmissions are free from delay, interruption, interception or error.
Privacy Outside the Website
Although we work with responsible third parties, their business policies may include different privacy policies and practices. Please be aware that when you click through to third-party websites, our privacy policies no longer apply and that we are not responsible for the privacy practices of these other sites. We encourage you to review the policies of each site you use.
How Can You Opt Out of Collection, Use and Disclosure of Your Information?
Whether you submit Personal Information to 38 Studios is entirely up to you. You may decide not to submit Personal Information through the Website, in which case 38 Studios may not be able to provide certain services to you. Please note that any information that you post, upload to or otherwise transmit to a public forum on the Website will remain visible in such forum and subject to our Terms and Conditions.
If you would like your Personal Information removed from our mailing list or database, please contact us at privacy@38Studios.com. In the event of any such removal, we may retain copies of information for our archives.
How Do I Access and Update My Information?
You may contact us by email to privacy@38Studios.com to see what Personal Information 38 Studios has collected from you and/or to request that 38 Studios remove your Personal Information from its mailing list or database. We will respond to any reasonable request by a user to review or amend his or her Personal Information held in our mailing list or database. We reserve the right to verify your identity in order to provide such access. Again, following such removal, 38 Studios may retain copies of your Personal Information for our archives.
Amendments
We may modify or amend this Privacy Policy from time to time. If we make any material changes, as determined by 38 Studios, to the way we collect, use or share your Personal Information, we may notify you of such changes through your User Account or by e-mail. This Privacy Policy will be available for your review on the Website. Your use of the Website following any amendment of this Privacy Policy will signify your acceptance of its revised terms.
